Abstract

La ley 1150 de 2007, que modificó parcialmente la ley 80 de 1993, transformó fundamentalmente las modalidades de selección en virtud del principio de eficiencia e implantó formas que por vía reglamentaría son parte de la nueva codificación de la contratación Colombia. Las reformas incluyen de una parte la incorporación de nuevas modalidades de selección a las existentes en licitación pública y de otro lado, la ampliación para algunas entidades del estado de los montos de la denominada menor cuantía en detrimento del contrato estatal, que significa excluir un número cada vez mayor de procesos de selección de la regla general de la licitación, siendo esta la modalidad de selección que mejor interpreta los principios de derecho público, especialmente el de transparencia, en el contexto de la nueva normatividad de contratación estatal colombiana

Law 1150 of 2007, which partially amended Law 80 of 1993, fundamentally changed the procedure for selection under the principle of efficiency and implemented by regulation forms that are part of the recodification of the hiring Colombia. The reforms include the introduction of some new forms of selection to the existing public procurement and on the other hand, the extension to certain entities of the state of the amounts of the so-called minor detriment of the state contract, which means excluding a number increasing the selection process of the bidding rule, this being the mode of selection that best interprets the principles of public law, especially the transparency in the context of the new Colombian government contracting regulations
