Principio de proporcionalidad en la Ley 1015 de 2006

Abstract

El presente trabajo tiene como objetivo general, analizar si el principio de proporcionalidad en el proceso disciplinario de la Policía Nacional de Colombia, descrito en la ley sustancial1,bajo un prisma ius naturalista se ve materializado, esto es, si la sanción disciplinaria se compadece con la conducta irregular que eventualmente pueda desplegar un servidor público, o si por el contrario nos encontramos ante un simple postulado jurídico vaciado de contenido como todo parece indicar, desconocedor por completo de un Estado antropocéntrico, que obliga a entender al hombre en su relación con el Estado de manera diferente como se concebía en la constitución de 1886.Con la nueva Constitución2, se cambió de paradigma, de un Estado de Derecho a un Estado Social de Derecho erigiéndose la dignidad humana como pilar fundamental de la Constitución.
