Abstract

El presente artículo de reflexión busca plantear una solución a la problemática que se suscita cuando se está frente a una privación de la libertad y la responsabilidad que en virtud de esta recae en el Estado colombiano, en atención a si debe o no responder patrimonialmente por la misma, cuando dicha privación se torna injusta ya sea porque la persona fue declarada penalmente inocente de los cargos imputados o porque dicha inocencia devino de la aplicación del principio del “in dubio pro reo”. Este ensayo se fundamenta principalmente en la evolución jurisprudencial que al interior de la Sección Tercera del Consejo de Estado ha tenido la responsabilidad patrimonial del Estado por privación injusta de la libertad, evolución que culmina con la reafirmación de la responsabilidad patrimonial del Estado bajo un régimen objetivo de responsabilidad sustentado en el daño especial, surgiendo para el Estado la obligación de indemnizar al ciudadano que no está obligado a soportar jurídicamente dicho daño. The present reflection article seeks to propose a solution to the problem that arises when you are facing a deprivation of liberty and the responsibility that lies with the Colombian State, if given under this should or not respond have an equity sharing, when such deprivation becomes unfair either because the person was declared fully innocent of the charges of which he is accused or such innocence became the application of the principle of the" in dubio pro reo". This essay is based mainly on the jurisprudential evolution that has had the liability of the State for wrongful deprivation of freedom, evolution that culminates with the reaffirmation of the liability of the State under an objective liability regime based on damage special, emerging to the State the obligation to compensate the citizen who is not required to support legally such damage to the interior of the third section of the Council of State.
