Abstract

El Procedimiento Administrativo Sancionatorio que trata el Articulo 86 de la Ley 1474 de 2011, y en relación al tema probatorio; el legislador faculta al contratista y su compañía garante que dentro de este procedimiento solicite o aporte pruebas. La misma normal señala que la administración pueda practicar las pruebas que estime conducentes y pertinentes para el desarrollo del procedimiento; por tal razón, el presente artículo presenta argumentos que buscan determinar la pertinencia de la prueba (Dictamen Pericial) dentro del Procedimiento Administrativo Sancionatorio para que sea tenida en cuenta por parte de la administración al momento de decretar medios de prueba que desvirtúan los hechos que generaron el inicio del Procedimiento. Sanctioning Administrative Procedure enshrined in Article 86 of Law 1474 of 2011, and in relation to the evidentiary issue; the legislature authorizes the contractor and its surety company that within this process request or provide evidence. The same rule states that government can practice the proof it deems appropriate and relevant to the proceedings; for this reason, this article presents arguments that seek to determine the relevance of Expert Report within the Sanctioning Administrative Procedure, to be taken into account by the administration at the time of ordering evidence that detracts the facts on which the procedure is based.
