Se trata de establecer si el concepto de números apertus vulnera el principio de legalidad, además de diferenciar claramente este concepto del de los tipos en blanco, abiertos o remisivos. En primer lugar se concretarán los conceptos de legalidad y tipicidad, a continuación el de números apertus, y posteriormente el de los tipos en blanco o abiertos. Dentro del presente documento se encontraran definiciones emitidas en la jurisprudencia existente y doctrinaria, que servirán como fuente sólida en la realización de los objetivos propuestos. Los números apertus han servido como garantía de los derechos constitucionales, pero también para restringir ciertas actuaciones de quienes tienen relación con la función pública.
