Gobernanza del agua y consejos de cuenca en américa latina: un análisis comparativo entre México, Colombia y Brasil

Abstract

Este artículo presenta un análisis comparativo de los consejos de cuenca en tres países de América Latina: México, Colombia y Brasil, estableciendo cuatro dimensiones de análisis: en conocer: el diseño normativo, las estructura y funcionamiento, los mecanismos de participación y capacidad de incidencia en la gestión del recurso hídrico y los desafíos de los mismos en su funcionalidad. Para abordar la problemática, se realizó una revisión documental y normativa, se examinan las similitudes y diferencias entre los modelos de gobernanza adoptados en cada país, identificando tanto avances como limitaciones en su implementación. Los tres países de estudio, han promovido la creación de instancias territoriales para la planificación hídrica, persisten desafíos comunes como la baja capacidad de decisión, la representación desigual de actores sociales, la débil articulación interinstitucional y la falta de recursos técnicos y financieros. Mientras que en México y Colombia los consejos tienen un carácter principalmente consultivo, en Brasil, los comités de cuenca cuentan con mayor autonomía y poder deliberativo. A partir de este análisis comparativo, se identifican lecciones útiles que aportan el fortalecimiento de la gobernanza del agua en la región, como la participación comunitaria en zonas rurales y los modelos de gestión con enfoque tripartito. Finalmente, el artículo plantea que avanzar hacia una gobernanza más efectiva y equitativa requiere reestructurar no solo el marco legal, sino también las condiciones reales de operación, asegurando una participación diversa, representativa y vinculante en la toma de decisiones sobre el recurso hídrico.

This article presents a comparative analysis of river basin councils in three Latin American countries: Mexico, Colombia, and Brazil. It establishes four dimensions of analysis aimed at understanding: the regulatory framework, the structure and functioning, the participation mechanisms, and the councils' capacity to influence water resource management, as well as the challenges they face in their functionality. To address this issue, a documentary and legal review was conducted, examining the similarities and differences between the governance models adopted in each country, identifying both advances and limitations in their implementation. The three countries under study have promoted the creation of territorial bodies for water planning; however, common challenges persist, such as limited decision-making capacity, unequal representation of social actors, weak inter-institutional coordination, and lack of technical and financial resources. While in Mexico and Colombia the councils have a mainly consultative role, in Brazil, basin committees have greater autonomy and deliberative power. Based on this comparative analysis, useful lessons are identified that contribute to strengthening water governance in the region, such as community participation in rural areas and tripartite management models. Finally, the article argues that moving toward more effective and equitable governance requires not only restructuring the legal framework, but also improving the actual operating conditions, ensuring diverse, representative, and binding participation in decision-making regarding water resources.
