Abstract

Se analizan las formas en las que el criterio subjetivo del juez impacta en la decision del otorgamientro del subrogado penal de libertad condicional, validando los fines de la pena o desnaturalizando, a través del desarrollo de una investigación socio jurídica en la que queda demostrado que esta potestad judicial tiene gran injerencia en lo relacionado con el cumplimiento de los objetivos del proceso penal en Colombia y la garantía de los derechos fundamentales; teniendo aspectos de contexto importantes, como el hacinamiento y demás problemáticas carcelarias que limitan el efectivo ejercicio de los fines humanizantes de la pena, ofreciendo como principal aporte, una opinión argumentada sobre adecuada aplicación de esta discrecionalidad en salvaguarda de los óptimos jurídicos que se pueden ofrecer a las personas condenadas a penas privativas de la libertad. The ways in which the subjective criterion of the judge impacts on the decision of the granting of the criminal surrogate of conditional freedom are analyzed, validating the purposes of the sentence or distorting them, through the development of a socio-legal investigation in which it is demonstrated that this The judicial authority has great influence in relation to the fulfillment of the objectives of the criminal process in Colombia and the guarantee of fundamental rights; having important contextual aspects, such as overcrowding and other prison problems that limit the effective exercise of the humanizing purposes of the sentence, offering as its main contribution, an argued opinion on the proper application of this discrepancy in safeguarding the legal optimum that can be offered to persons sentenced to custodial sentences.
