El secreto comercial es un valor activo de las empresas, que en la actualidad en un mundo interconectado y de libre mercado, se ha convertido en objeto de protección por diversas vías. Fue importante esta nueva generación de tecnologías, fundamentalmente en materia de comunicaciones, puesto que supuso para individuos y organizaciones la posibilidad de comprender mejor las relaciones humanas del mundo, favoreciendo con ello su interacción comercial, es decir la posibilidad de vender y comprar. El secreto comercial toma un valor fundamental, sobre todo en economías en desarrollo como la colombiana o las de la región, dado que la inserción en un mercado interconectado supone una vulnerabilidad mayor, frente a empresas de carácter multinacional por ejemplo, que controlan grandes conglomerados comerciales que en ocasiones, llegan a ser más fuertes que los mismos Estados.
