Consultas populares y explotación de recursos naturales en Colombia

Abstract

Las consultas populares en Colombia son una herramienta que garantiza los derechos o intereses colectivos, utilizadas por las comunidades para protección de los derechos culturales y del medio ambiente. El Estado, propietario del subsuelo, debe procurar que entre éste y los explotadores mineros exista una ejecución coordinada con las comunidades. Sin embargo, la necesidad del desarrollo del país y el derecho a gozar de un ambiente sano ha generado una problemática. Por tal motivo, el presente trabajo de investigación realiza una conceptualización de la normativa histórica sobre las minas en Colombia y el desarrollo evolutivo de la consulta popular. Aquí se deja ver hasta qué punto se puede limitar la explotación de los recursos naturales no renovables, haciendo uso de tal herramienta constitucional, la cual se ha buscado no sea radical y negatoria respecto de la explotación de recursos naturales. Todo ello, con la finalidad de analizar, mediante el método de análisis de la jurisprudencia de las Altas Cortes, la forma en que se ha interpretado el alcance de las consultas populares frente a la explotación de los recursos naturales en las comunidades. Popular consultations in Colombia are a tool that guarantees collective rights or interests, used by communities to protect cultural rights and the environment. The subsoil is property of the State, which, together with mining exploitation, occupies a harmony and coordinated execution with the communities. The need for the country's development and the right to enjoy a healthy environment has created a problem. The research work makes a conceptualization of the historical regulations on mines in Colombia and the evolutionary development of the popular consultation. Here we can see to what extent the exploitation of non-renewable natural resources can be limited, making use of such a constitutional tool, which has been sought not to be radical and negative regarding the exploitation of natural resources. Through the method of analysis that the high courts do, the solution is found in the present work with respect to the subject matter.
