Abstract

El ciberespacio ofrece beneficios para la sociedad, pero también permite la aparición de fenómenos como la ciberguerra con medios y métodos de conducción de hostilidades, para conflictos armados internacionales o no internacionales. La ciberguerra puede generar perjuicios incalculables en la población civil y sus bienes, por cuanto la diferenciación entre personas y bienes civiles vs objetivos militares, a la que obliga el principio de Distinción del DIH, puede ser difícil de realizar. En la ciberguerra los bandos desaparecen y las fronteras son invisibles, por tanto, se hace necesario establecer el verdadero alcance que este principio tiene para con la ciberguerra y los ciberataques, con el propósito de proteger los bienes y derechos de aquellos que no participan en las confrontaciones armadas. Del análisis a efectuarse se determinará que la normativa existente, aun cuando fue emitida desde hace muchos años puede aplicarse para esta nueva clase de conflictos armados. Cyberspace offers benefits for society, but it also allows phenomena such as cyberwarfare with the means and methods of conducting hostilities, for international or non-international armed conflicts. Cyberwar can cause incalculable damages to the civilian population and their assets, since the differentiation between civilian persons and assets vs. military objectives, which the principle of Distinction of IHL requires, can be difficult to perform. In cyberwar the sides disappear and the borders are invisible, therefore, it is necessary to establish the true scope that this principle has for silverware and cyber attacks, in order to protect the assets and rights of those who do not participate in armed confrontations. From the analysis to be carried out, it will be determined that the existing regulations, even when issued for many years, can be applied for this new class of armed conflicts. Maestría
