El presente artículo analizó los componentes del ordenamiento jurídico colombiano sobre la imprescriptibilidad de la acción disciplinaria cuando se trata de violaciones a los Derechos Humanos y graves infracciones al Derecho Internacional Humanitario por parte de las Fuerzas Militares, a través de un método de investigación cualitativo, utilizando la hermenéutica de documentos doctrinales y jurisprudenciales en la materia. Sin embargo, la problemática sobre el particular radica en que dicha acción tiene un término prescriptivo de 12 años contemplado en la Ley 1862 de 2017, y que por estándares internacionales en materia de investigación y sanción debe ser corregida con el propósito de efectivizar la acción disciplinaria y el respeto por el derecho a la justicia de las víctimas. Lo anterior, teniendo en cuenta que los mandatos de la Corte Interamericana no han sido materializados por los Estados parte de la Convención, de ahí que haya que buscar mecanismos más expeditos tendientes a adecuar la legislación interna. This article analyzed the components of the Colombian legal system on the imprescriptibility of disciplinary action when dealing with Human Rights violations and serious violations of International Humanitarian Law by the Military Forces, through a qualitative research method, using the hermeneutics of doctrinal and jurisprudential documents on the matter.
