Limitar la edad para practicar la eutanasia vulnerado el derecho a morir dignamente

Abstract

En el año 2017 la Corte Constitucional hace extensivo la aplicación del procedimiento eutanásico a los niños, niñas y adolescentes, bajo el desarrollo del derecho a morir dignamente y en atención al principio de interés superior del menor. El Gobierno Nacional de acuerdo con los desarrollos jurisprudenciales indicados, reguló el derecho a morir dignamente de los niños, niñas y adolescentes mediante la Resolución 825 de 2018, indicando que solo podrán tener acceso a ello, los niños mayores de 12 años. En ese contexto se desenvuelve el presente artículo de investigación, cuyo objetivo general es analizar si la regulación colombiana del proceso eutanásico en niños, niñas y adolescentes respeta el derecho a morir dignamente, o si por el contrario al limitar el acceso a este a solo a los niños mayores de 12 años se esta vulnerando dicho derecho a la población de niños menores de doce años. Para el efecto se realiza un análisis de la regulación de Bélgica y Holanda, llegando a la conclusión de que no existen razones objetivas para que el legislador colombiano limite el acceso a la eutanasia a los niños menores de doce años. In 2017, the Constitutional Court extended the application of the euthanic procedure to children and adolescents, under the development of the right to die with dignity and in accordance with the principle of the best interests of the minor. The National Government, in accordance with the indicated jurisprudential developments, regulated the right to die with dignity for children and adolescents through Resolution 825 of 2018, indicating that only children over 12 years of age may have access to it. In this context, the present research article is developed, whose general objective is to analyze if the Colombian regulation of the euthanasia process in children and adolescents respects the right to die with dignity, or if, on the contrary, by limiting access to it only to children over 12 years of age are violating this right to the population of children under twelve. For this purpose, an analysis of the regulation of Belgium and the Netherlands is carried out, concluding that there are no objective reasons for the Colombian legislator to limit euthanasia access to children under the age of twelve.
