Abstract

The deprivation of liberty as a punitive element of the State does not infer, nor is it ingrained, nor does it ingrain the loss of dignity and personal integrity of the sentenced in the opportunity to return as a participatory element of the society from which it was temporarily set apart. Within the purposes of the Punishment having special prevention and social reintegration operate at the time of the execution of the prison sentence. This investigation provides a comparison of the mechanisms to be substituted for the custodial sentence and Administrative Benefits applicable in The Ordinary Jurisdiction Law 599 of 2000, Law 65 of 1993 and Law 1709 of 2014, as well as those presented in the Special Jurisdiction of Peace for service members deprived of liberty under Law 1820 of 2016.
