La privación de la libertad derivada de la declaratoria de culpabilidad de un individuo y resultante de la materialización del poder punitivo del Estado, no implica la perdida de dignidad humana e integridad personal del penado, por el contrario, brinda la oportunidad de poder retornar como elemento participativo a la sociedad de la cual fue apartado temporalmente; ahora bien, las funciones de la pena operan en el momento de la ejecución de la misma y varían teniendo en cuenta el destinatario de la misma y su forma de ejecución. Esta investigación establece una comparación de los mecanismos sustitutivos a la pena privativa de la libertad y de los beneficios administrativos aplicables en la Ley 599 de 2000, Ley 65 de 1993 y la Ley 1709 de 2014, así como los que se presentan en la Jurisdicción Especial de Paz para los militares privados de la libertad en cumplimiento de la Ley 1820 de 2016.
