Abstract

Este articulo es el resultado de la revisión de la doctrina y la jurisprudencia respecto de la imputación fáctica y jurídica de responsabilidad patrimonial extracontractual al estado, como uno de los elementos estructurales de responsabilidad, consagrados en la Constitución de 1991 junto con el daño antijurídico, a titulo de falla del servicio, daño especial o riesgo excepcional, se hace en primer lugar, un repaso histórico en cuanto a la evolución y desarrollo en Colombia de estos títulos de imputación jurídica, para entrar a determinar las características de cada uno de ellos a través de los regímenes de responsabilidad subjetivo y objetivo, finalmente se hace referencia al principio iura novit curia, como principio de aplicación excepcional en los procesos contenciosos administrativos, en la acción de reparación directa, por cuanto se le permite al juez interpretar y precisar el titulo de imputación aplicable
