Abstract

Ante las restricciones legales y contrapuestos pronunciamientos que existieron entre la Corte Suprema de Justicia y el Tribunal Superior Militar frente a la concesión de la prisión domiciliaria del aforado cabeza de familia en la jurisdicción penal militar, se investigó cuáles eran los principios y normas que debieron incorporarse al Código Penal Militar, por la vía del principio de integración, para otorgar el referido subrogado en pro del derecho de los niños a crecer en una familia. De allí que se debatió, ¿por qué el interés superior del menor obligaba al Tribunal Militar a aplicar el principio de integración para conceder la prisión domiciliaria al aforado padre o madre cabeza de familia?, superando así el problema de validez normativo que planteó Robert Alexy y Luis Recasens, para lo cual se aplicó el método Delphi, donde se consultaron cinco expertos para dar respuesta a la pregunta de investigación que se formuló.

Given the legal restrictions and conflicting pronouncements that existed between the Supreme Court of Justice and the Military Superior Court in front of the concession of the house arrest of the family head in the military criminal jurisdiction, the principles and norms that had to be incorporated to the Military Criminal Code, by way of the principle of integration, to grant the said subrogation in favor of the right of children to grow up in a family. Hence it was discussed, ¿why the best interests of the minor forced the Superior Military Court to apply the principle of integration to grant house arrest to the father or mother head of family?, thus overcoming the problem of normative validity posed by Robert Alexy and Luis Recasens, for which the Delphi method was applied, where five experts were consulted to answer the research question that was asked.
