Abstract

En Colombia, la ley 1098 del 2006 creó el Sistema de Responsabilidad Penal Adolescente (SRPA) como el conjunto de principios, normas, procedimientos, autoridades judiciales especializadas y entes administrativos que rigen o intervienen en la investigación y juzgamiento de delitos cometidos por personas que tengan entre catorce (14) y dieciocho (18) años. Mediante este sistema, el cual representa la doctrina de la protección integral, se ha buscado determinar cuál es el grado de responsabilidad penal de los adolescentes que hicieron parte de grupos armados al margen de la ley y tuvieron participación en conductas punibles. Sin embargo, se ha atravesado por situaciones de inseguridad jurídica respecto del tratamiento a estos adolescentes al reconocer que igualmente son víctimas del delito de reclutamiento forzado. Es por esto, que resulta primordial analizar la situación jurídica de los adolescentes desvinculados de grupos armados ilegales que son reportados al SRPA y estudiar los mecanismos externos para un proceso de restablecimiento de derechos, teniendo en cuenta que el derecho a la educación es fundamental en un proceso de reincorporación. In Colombia, within the Criminal Policy, the Adolescent Criminal Responsibility System (PACR) was created, through Law 1098 of 2006, as the set of principles, rules, procedures, specialized judicial authorities and administrative bodies that govern or intervene in the investigation and prosecution of crimes committed by persons between fourteen (14) and eighteen (18) years of age at the time of committing the punishable act. Through this system, which represents the doctrine of comprehensive protection, it has been sought to determine the degree of criminal responsibility of adolescents who were part of armed groups outside the law and participated in punishable behavior. However, it has been crossed by situations of legal uncertainty regarding the treatment of these adolescents, recognizing that they are also victims of the crime of forced recruitment. This is why it is essential to analyze the legal situation of adolescents separated from illegal armed groups who are reported to the PACU and, consequently, to study the external mechanisms for a process of restoration of rights, understanding that the right to education is fundamental in a reincorporation process.
