La infancia ante el sistema interamericano

Abstract

El presente artículo analizará la evolución que han tenido los derechos Humanos de la Niñez en América Latina. El Sistema Interamericano de Derechos Humanos ha conocido diversos casos sobre los cuales ha debido pronunciarse de manera más específica respecto al contenido de los derechos de los niños. La Doctrina de la Protección Especial contempla varios principios entre los que se destaca el interés Superior del Niño, por ser uno de los principios más importantes en materia de derechos del niño. Los niños no sólo son sujetos de protección especial sino plenos sujetos de derecho y, así, lo ha entendido la Corte en sus fallos. Por ende al analizar las enseñanzas del Sistema Interamericano podremos encontrar por qué y como se han conformado los verdaderos estándares interamericanos en lo que respecta a la población más vulnerable, los niños, niñas y adolescentes.

This article analyzes the developments that have taken Human rights Children in Latin America. American system through the Inter-American Court has known several cases on which he has had to rule more specific about the content of the rights of children. The Special Protection Doctrine includes several principles from which emphasize the importance of the Child to be one of the most important principles on the rights of the child. Children are not only subject to special protection but full subjects of law and, thus, it was the Court in its judgments. Thus when analyzing the teachings of the Inter we find out why and how they have shaped the true inter-American standards with respect to the most vulnerable population, children and adolescents.
