Abstract

El objetivo principal del presente escrito, es visibilizar la problemática actual que sufre la justicia en Colombia. Los paros y la vacancia judicial impiden el adecuado acceso a la justicia, así como el cumplimiento del principio constitucional al debido proceso. La resolución efectiva de controversias se ve alterada por lo menos una vez cada año por cuenta de los hechos enunciados anteriormente, ello dificulta la convivencia pacífica entre los ciudadanos quienes no ven garantizados sus derechos básicos y fundamentales. La acción constitucional de nulidad y restablecimiento del derecho, tiene un término de caducidad de 4 meses; un tiempo relativamente corto para la reclamación de un derecho, sumado a eso el ciudadano debe soportar la parálisis en la administración de justicia y este término se ve afectado de manera directa por estas situaciones. En ese orden de ideas el documento busca analizar las situaciones concretas en cuanto a la administración y acceso a la justicia, determinar la problemática actual en el conteo de términos cuando media un paro y/o vacancia judicial, así mismo se determinará la tesis que maneja tanto la Corte Constitucional, como el Consejo de Estado en materia de caducidad con relación a los paros o vacancias judiciales. Las conclusiones serán presentadas al finalizar el análisis teórico y jurisprudencial en este escrito. En conclusión, el Consejo de Estado y la Corte Constitucional deberán unificar criterios para examinar cada uno de los casos a fallar, teniendo en cuenta la ocurrencia de paros y vacancias judiciales y con ello hacer un conteo de términos que corresponda con los ceses de actividades que se puedan presentar en el año. The main objective of this paper is to make visible the current problems of justice in Colombia. Unemployment and judicial vacancies impede adequate access to justice, as well as compliance with the constitutional principle of due process. The effective resolution of disputes is altered at least once every year because of the facts stated above, this makes difficult the peaceful coexistence among citizens who do not see their basic and basic rights guaranteed. The constitutional action of nullity and reestablishment of the right, has a term of expiration of 4 months; A relatively short time for the claim of a right, added to that the citizen must endure paralysis in the administration of justice and this term is directly affected by these situations. In this line of thinking, the document seeks to analyze the specific situations in terms of administration and access to justice, to determine the current problem in counting terms when a strike is halted and / or judicial vacancy, as well as determine the thesis that handles Both the Constitutional Court, and the State Council regarding expiration with regard to judicial stops or vacancies. The conclusions will be presented at the end of the theoretical and jurisprudential analysis in this writing. In conclusion, the Council of State and the Constitutional Court should unify criteria to examine each of the cases to be decided, taking into account the occurrence of judicial stops and vacancies and with that to do a counting of terms that corresponds to the cessation of activities that Can be presented in the year.
