Abstract

El presente ensayo de investigación, analiza en vacío jurídico contemplado en el artículo 5 del decreto ley 4433 de 2004, “por medio del cual se fija el régimen pensional y de asignación de retiro de los miembros de la Fuerza Pública” puesto que desconoce el reconocimiento y pago del subsidio familiar del menor concebido pero no nacido, llamado en el argot jurídico como “Nasciturus” con base en el análisis jurisprudencial y Doctrinario se pretende establecer la conexidad del subsidio familiar con el derecho fundamental a la seguridad social del menor contemplado en el artículo 44 de la constitución política, por lo que será susceptible de protección mediante acción de tutela, finalmente se propone modificar la norma vigente mediante una iniciativa legislativa, o sacarla del ordenamiento jurídico mediante demanda de inconstitucionalidad. Durante el desarrollo del presente ensayo el lector evidenciara la importancia de abordar esta problemática salarial originada en el régimen pensional propio de las fuerzas Militares. This research paper analyzes the contemplated legal vacuum in Article 5 of Decree Law 4433 of 2004, "by which the pension and retirement allocation of members of the security forces regime fixed" since unknown recognition and child benefit child conceived but not born, known in legal jargon as "Nasciturus" based on the jurisprudential and Doctrinal analysis is to establish the connectedness of the family allowance with the fundamental right to social security of the child referred to in Article 44 of the constitution, which will be capable of protection tutela finally proposed to amend the existing rule by legislative or out of the law by initiative constitutional claim. During assay development the reader determine the importance of addressing this wage problem originated in the own pension regime of the military forces.
