Abstract

Con el presente ensayo busco estudiar si resulta el artículo 361 del Código de Procedimiento Penal, violatorio de principios como el de la Justicia material, debiendo indicar que la presente investigación ostenta un tinte social por cuanto se busca obtener o brindar claridad respecto de la afectación o no, que pueda tener al interior de nuestro ordenamiento jurídico el prohibir al Juez Penal decretar pruebas de oficio, prohibición que de manera taxativa se encuentra contemplada en el artículo 361 del Código de Procedimiento Penal, y que so pena de haberse tratado jurisprudencialmente no resulta claro si existe o no vulneración al principio mencionado, concluyendo desde mi estudio que efectivamente la norma en mención incurre en una afectación al principio de la Justicia material puesto que restringe al juez en su actividad probatoria. With this essay I seek to study whether it is Article 361 of the Code of Criminal Procedure, which violates principles such as material Justice , it should indicate that this research holds a social tinge because it seeks to obtain or provide clarity regarding the involvement or no, you may have within our legal order prohibiting the Criminal Judge decree evidence ex officio , prohibition exhaustively is referred to in Article 361 of the Code of Criminal Procedure, and that under penalty of having treated jurisprudencialmente not clear whether or not breach the principle mentioned, concluding from my study actually the norm in question incurs an affectation to the principle of material justice since it restricts the judge in their presentation of evidence
