Abstract

En presente documento ubica, en primer lugar, el fundamento constitucional y legal de la responsabilidad extracontractual del Estado colombiano, al tiempo que se expone unos criterios teórico básico de la institución jurídica que es objeto de la presente investigación. Para su desarrollo se indagó, identificó y se estudió las sentencias que sirvieron de instrumento para desarrollar la responsabilidad del Estado colombiano por actos terroristas con el objeto de determinar cuándo y bajo qué título de imputación se configura la responsabilidad extracontractual del Estado colombiano como consecuencia de actos catalogados como terroristas, utilizando una metodología de investigación de orden cualitativo y de tipo documental. Finalmente se aterriza el análisis anterior con unas conclusiones que responde a la pregunta planteada donde se evidencia que a pesar del desarrollo jurisprudencia y de los fallos de unificación en el 2012 no se privilegia ningún régimen o sistema de imputación. This papper tells, first of all, the constitutional and legal basis of the tort of the Colombian government, at the same time that is exposed the theorical and practical criteria of the juridic institution that is object of this research. For its development it was surveyed, identified and studied the court rulings that were tools to determine when and under which imputation title the tort is set up as consequence of acts qualified as terrorism, using a qualitative and documental research methodologies. Finally the analysis concludes answering the question where the evidence that besides of the development of the jurisprudence and the court rulings of unification on 2012 it was not privileged any regime or imputation system.
