En aras de garantizar los derechos fundamentales de las comunidades étnicas, es conveniente analizar que instante es el realmente conveniente para la comunidad étnica, no para el estado ni los beneficiarios de la explotación o concesión, llevar a cabo la consulta previa, puesto que en muchos casos se realiza esta consulta una vez ya se ha dado inicio a la etapa de exploración o explotación, habiendo ya causado un daño ambiental, social, cultural a las grupos étnicos, esto se presenta puesto que no se da cumplimiento a la normatividad la cual establece que se debe hacer de manera previa a la adopción de medidas administrativas, legislativas o a la decisión sobre proyectos que puedan afectarles.
