Abstract

La siguiente investigación está enfocada en la responsabilidad del Estado por el daño antijurídico imputado, como consecuencia de la falla en el servicio dentro de los establecimientos carcelarios en Colombia, por la acción u omisión del ingreso de elementos prohibidos, que facilitan a los internos atentar contra la integridad física de las personas privadas de la libertad. Encontraremos los diferentes procedimientos que son “aplicados por el Instituto Nacional Penitenciario y Carcelario – INPEC” para velar por el deber de cuidado hasta que los internos cumplan sus medidas de aseguramiento o condena. Precisamente, esta falla en el servicio, como tal, genera que los afectados directos con la actuación o la omisión de la administración puedan demandar ante la jurisdicción por los derechos que son claramente afectados.

The following investigation is focused in the responsibility of the state caused for the non-juridical damage, as consequence of the failure of service inside of the prisons and jails in Colombia, by the action or omission in the control of the incoming of forbidden elements that allows the prisoners to infringe damage against the personal integrity of their mates. We can find different procedures that are applied by the National Institute of Penitentiaries and Prisons (INPEC) in its duty of care during the security measures or criminal sentences. Precisely, this failure in the service generates that the directly affected with the action or omission of the administration can sue before the justice in defense of the violated rights.
