La aplicación en la extensión de jurisprudencia del consejo de estado en Colombia

Abstract

Con este trabajo se pretende determinar, si la falta de aplicación de la figura de unificación de jurisprudencia del Consejo de Estado expresada en el artículo 102 de la Ley 1437 de 2011 (código de procedimiento administrativo y de lo contencioso administrativo) por parte de las autoridades, vulnera el Derecho a la Igualdad, para lo cual, se relacionaran estudios y Jurisprudencia con el fin de indagar en el tema y establecer la eficiencia y la afectación al sistema judicial administrativo dentro del ámbito de las prestaciones laborales.

With this work is to determine if the failure to implement the figure of unification of jurisprudence of the State Council expressed in Article 102 of Law 1437 of 2011 (Code of Administrative Procedure and Administrative Disputes) by the authorities violates the right to equality, for which, studies and Jurisprudence were related in order to investigate the issue and to establish the efficiency and the administrative judiciary involvement in the field of employee benefits.
