Abstract

Tanto las empresas como las organizaciones sindicales deben enfrentar el proceso de la Negociación Colectiva de Trabajo, por ser un paso de obligatorio cumplimiento mirándolo desde le punto de vista legal que existe en la vida laboral por la esencia de la relación entre las partes. Una vez se crea la organización sindical, por parte de los trabajadores, se debe cumplir unos requerimientos de ley que conllevan a que estos entren en discusión de los intereses de los trabajadores plasmados en el pliego de peticiones. En Colombia a pesar de existir convenios internacionales de la OIT ratificados por el gobierno nacional, existen empresas que no se preocupan por su cumplimento y a decir verdad se rebuscan formas de evadir las responsabilidades o simplemente plantean estrategias de batalla para hacerle el quite a los sindicatos.
