Abstract

La inimputabilidad de acuerdo con la dogmática penal se ubica en la culpabilidad, donde aquella no exime de responsabilidad, sino que la conducta se adecua por razones endógenas y exógenas del autor, condición que no generara un juicio de reproche absoluto, pues para que pueda ser de tal magnitud, dichas características deben estar ausentes al momento de cometer el injusto penal condiciones psíquicas, físicas y cognoscitivas; teniendo en cuenta la función militar y su régimen, encontramos que la actividad humana desplegada encuentra en el ámbito de la inimputabilidad aspectos que permiten adecuar decisiones en los ámbitos del proceso penal militar.

Criminal responsibility in accordance with the criminal dogma is located in the guilt, where that does not exempt from responsibility, but the behavior is adapted from endogenous and exogenous reasons of the author, condition that does not generate any reproach judgment, because for it to be of such magnitude , such characteristics should be absent when they commit the psychological unfair, physical and cognitive criminal conditions; given the military role and his regime, we found that human activity deployed finds in the field of criminal responsibility aspects that allow to adapt decisions in the fields of military criminal process.
