Constitucionalmente el principio de oportunidad se instauró en el año 2002 y fue regulado mediante la Ley 906 de 2004 que expidió un nuevo estatuto procesal para Colombia. El principio de oportunidad se presentó como una herramienta que permitía suspender, interrumpir o renunciar a la acción penal siempre y cuando se cumplieran ciertos parámetros establecidos legalmente. No obstante haberse postulado como una forma de luchar contra el crimen organizado y descongestionar el sistema judicial, la realidad refleja una situación muy diferente a la que se planteó en sus inicios. Uno de los problemas puntuales que plantea la realidad jurídica es qué se debe hacer cuando se tiene conocimiento de una conducta punible carente de lesividad. A lo largo de esta investigación se estima dar una respuesta ajustada a derecho a este dilema jurídico.
Prosecutorial discrection was established in the constitution in 2002 and it was regulated by Law 906 of 2004 through which the new criminal procedure code was issued. The prosecutorial discrection was shown as a tool that allowed suspend, interrupt or renounce penal action as provided certain parameters are met legally established. However has been established as a way to fight against organized crime and congestion in the judicial system, actually reflects a very different situation that was raised in its infancy. One of the specific problems posed by the reality is what to do when you have knowledge about a felony harmless. Throughout this research it will give an appropriate answer to this legal problem
