Desnaturalización del contrato administrativo de prestación de servicios

Abstract

Este ensayo busca abordar sobre el contrato de prestación de servicios, su utilización y mostrar como en ocasiones se usa para lograr contrataciones que no deben realizarse con esta figura laboral. El régimen jurídico Colombiano tiene previstas tres clases de vinculaciones con entidades del Estado, para lograr los cometidos y fines del mismo; estas son: como empleados públicos, trabajadores oficiales y contratistas de prestación de servicios, cada uno con sus características específicas. En los primeros su nombramiento se da mediante decreto, resolución u otro acto administrativo, mientras que los trabajadores oficiales son vinculados mediante contrato de trabajo, las vinculaciones que se den bajo la prestación de servicios tienen unas características especificas que de no cumplirse estarían desdibujando relaciones laborales y violando derechos de los trabajadores.

This paper seeks to address on the contract to provide services, use and show how sometimes used to achieve contracts that should not be done with this job figure. The Colombian legal system has provided three kinds of links with state agencies to achieve the tasks and purposes thereof; These are: as public employees, public employees and contractors to provide services , each with its specific characteristics. In the first appointment is given by decree , resolution or other administrative act , while public employees are bound by contract of employment , linkages to be given under the provision of services have some specific features that are not met would blurring labor relations and violating workers' rights .
