This research pretends to analyze the best-known features based on the military regional Colombian court within its own legal system. It has been pointed out in the principles of the Colombian Constitution that its origins come from the executive filed as well as the main characteristics which may affect how it could be applied, and what it is the difference in the currently court decisions, Besides the historical development of this kind of justice, relevant aspects were established to grasp up whether punitive human-behaviored actions carried out by military service body, must be recognized by the police force members and the military law system.

La presente elaboración escrita tiene como objetivo analizar los diferentes aspectos que enmarcan la institución del fuero militar, en su concepción y marco jurídico colombiano. Se ha fijado su ubicación a partir del entramado constitucional, donde ésta tiene su anclaje en la rama ejecutiva, así como las características que pueden incidir en su aplicación y que la diferencia de la justicia ordinaria; además, de reconocer su desarrollo histórico, se fijaron los aspectos claves para discernir si la conducta delictiva,ejecutada por un militar o policía, debe ser conocida por la justicia penal militar o la ordinaria..
