La culpabilidad es un principio rector del derecho sancionador y actúa como límite del Derecho Punitivo del Estado que ha tenido gran relevancia. Es necesario establecer que no hay pena sin culpabilidad y que la culpabilidad tiene que ser punto de referencia para interponer la pena que corresponde en cada caso. Así las cosas, la culpabilidad tiene que ser punto de referencia para interponer la sanción que corresponde en cada caso, si quien cometió la falta es imputable esa falta tiene su sanción, es así como al existir culpabilidad se debe exigir la elaboración de un juicio de reproche que imponga finalmente una sanción.
