Con el presente artículo se pretende entregar una herramienta útil al operador jurídico que ejerce la defensa penal con la finalidad de que pueda solicitar al juez de control de garantías, a través de la figura del denominado Bloque de Constitucionalidad, la libertad del procesado cuando una vez iniciado el juicio oral, violándose los principios de concentración y plazo razonable, éste se ha extendido indebidamente en el tiempo, trayendo como consecuencia la presencia de la figura de la prolongación ilegítima de la privación de la libertad, invocando para ello diversas decisiones jurisprudenciales, en especial de la Corte Interamericana de Derechos Humanos. With this article we try to provide to the defender an useful tool in order to ask the judge to guarantee through the figure of the so-called Constitutional Bloc, the defendant's liberty when once the trial, violated the principles of concentration and reasonable time, it has spread unduly in time, consequently resulting in the presence of the figure of the extension illegitimate deprivation of liberty, invoking various court decisions, in particular the Inter-American Court of Human Rights.
