La normatividad vigente en materia de derecho administrativo consagra la posibilidad de manera genérica de que las autoridades públicas demanden ante lo contencioso sus propios actos, a fin de excluirlos del ordenamiento jurídico por ser contrarios a la Constitución o la Ley, existiendo un vacío respecto de la reglamentación de tal herramienta, el cual ha sido resuelto por vía jurisprudencial y doctrinal, motivo por el cual, cualquier intento de abordar el tema necesariamente deberá hacerse a partir de la recopilación y examen de los pronunciamientos de las altas cortes y estudiosos del derecho.
