Abstract

Este artículo permite establecer si el derecho de petición, cumple con los lineamientos conforme a su real naturaleza para ser categorizado como derecho fundamental, realizándose un recorrido histórico por las anteriores Constituciones Políticas de Colombia, análisis jurisprudencial y estudio de derecho constitucional comparado, utilizando investigación descriptiva, diseño de investigación bibliográfica y realizando un análisis hermenéutico que permite la consecución de elementos que indican, que este derecho no cumple con los requisitos establecidos por la Corte Constitucional y por lineamientos internacionales para catalogarlo como derecho de primera generación, concluyendo que conforme a sus componentes actuales y características, es viable posicionarlo entre los derechos de segunda generación, lo que posibilita predicar, que no debería gozar de los efectos de los derechos fundamentales en cuanto a su protección. This article establishes the right of petition, to comply with guidelines in accordance with their real nature to be categorized as a fundamental right, so a historical tour of the previous political constitutions of Colombia, jurisprudential analysis and study of comparative, constitutional law is done using descriptive research, bibliographic research design and performing a hermeneutic analysis which allows the achievement of elements that indicate that this right does not comply with the requirements established by the Constitutional Court and international guidelines to categorize it as first generation right, concluding it is viable to position it among the second generation rights, according to their characteristics and current components, making it possible to preach, that he should not enjoy the effects of fundamental rights in terms of their protection.
