The change of juridical culture in the relation doctor - patient demonstrated in the affirmation of the beginning of autonomy of the person, supposed leaving to the margin a relation characterized by a sense paternalistic and been ruled by the be-ginning of welfare, to reach a new situation, according to time, in that the patient and his rights are formed as the protagonists, it is because of it, that arises the need to establish if it exists or not contractual responsibility of the physician when one signs a medical informed assent.

El cambio de cultura jurídica en la relación médico-paciente, evidenciado en la afirmación del principio de autonomía de la persona, supuso dejar al margen una relación con sentido paternalista y regida por el principio de beneficencia, para alcanzar una nueva situación, acorde con los tiempos, en la que el paciente y sus derechos se configuran como los protagonistas, es por eso, que surge la necesi-dad de establecer si existe o no responsabilidad contractual del galeno cuando se suscribe un consentimiento médico informado.
