Abstract

El presente artículo materializa un análisis sobre los cambios de reglas procedimentales presentados en materia documental con la entrada en vigencia del Sistema Penal Acusatorio en Colombia que empezó a regir paulatinamente en el territorio desde el año 2005 a través de la Ley 906 de 2004. Esta nueva Ley exige al ejercicio de la profesión un estudio exhaustivo frente a las evidencias recaudadas, así como, una introducción más técnica y formal de las mismas al proceso penal. Es claro entonces, que se aplicaron técnicas establecidas en la forma de recolección, embalaje y rotulación de estos elementos materiales probatorios, y que como resultado de esta aplicación, se da claridad y buen manejo a la evidencia obtenida a partir de este documento. In this article we analyze the procedure rules that are applied to documental material within the enforcement of the new” accusatory system” in Colombia since 2005. The new system started to be enforced only in few regions of the country and now it is enforced all across the nation. That´s why, in the practice of the legal profession, there´s a need of a comprehensive study of the evidence collected since 2005, as also a need of a more technical and formal introduction of the evidence to the process established in the new accusatory system. It is clear then, that the new techniques established to recollect, pack and label the evidentiary material were applied in the correct way and, as a consequence of this, there´s a transparent and good handling of the evidence recollected.
