Abstract

Este documento estudia la relación entre policía judicial y el debido proceso en el marco del procedimiento penal. Estableciendo una caracterización de la policía judicial con fundamento en las funciones legales y constitucionales que este órgano debe cumplir en aras a que la fase investigativa del proceso contribuya al esclarecimiento de la verdad, precisando en que eventos las funciones desempeñadas por la policía judicial posibilitan la materialización o la vulneración del debido proceso, entendiendo este derecho en todas las dimensiones que orientan el proceso penal. The criminal regulation of modern states is indomitably directed to the protection of property legally protected reason these processes , media and phases of criminal investigation from the beginning of the wrongful act must follow the parameters legislative and constitutional principles as a way of preserve the teleology of the system, which is why the normative evaluation of the judicial police understood as a set of procedures and entities within the adversarial system must be weighed against the difficult balance of proper criminal investigation related to fair pay and a discrete activity not threaten or violate fundamental guarantees but instead contributes to the effective guarantee and / or embodiment , as with the right to due process can be undermined due to lack of resources , personnel and logistical backing of the judicial police .
