Partiendo de la premisa que la ley penal en Colombia es aplicable en todo el territorio nacional, se analiza un caso especial frente a la inimputabilidad de la persona indígena con fundamento en el principio expresado por la Corte Constitucional como “diversidad sociocultural”, como expresión del reconocimiento de un Estado pluralista. En desarrollo de lo anterior se acude a fuentes normativas, dogmáticas y jurisprudenciales tratando, en principio y de forma general, los conceptos de imputabilidad e inimputabilidad; posteriormente, se explica el significado y alcance del principio de diversidad sociocultural en relación con la inimputabilidad de la persona indígena.
Based on the premise that the criminal law in Colombia is applicable throughout the national territory, it discusses a special case compared to the unimputability of the indigenous person on the basis of the principle expressed by the Constitutional Court as a “sociocultural diversity”, as an expression of recognition of a pluralist State. In development of the above comes to normative sources, dogmatic and jurisprudential, particularly seeking the concepts of imputability and unimputability; subsequently, explains the meaning and scope of the principle of sociocultural diversity in relation to the unimputability of the indigenous person.
