Conciencia de antijuridicidad

Abstract

A través de este artículo se hizo un análisis del concepto de conciencia de antijuridicidad, revisando los diferentes alcances que se le han dado a esta noción a lo largo de la historia pasando por distintas teorías, así como también las modalidades que logran excluirlo. Siendo obligatorio mencionar las implicaciones relativas a la objeción de conciencia y a las consideraciones que al respecto ha señalado la Corte Constitucional de Colombia en casos en los que aunque se ha encontrado probada la conciencia de antijuridicidad, expresamente advierte que no se puede hablar de responsabilidad, pues no se pueden desconocer los principios fundantes del Estado actual ni los derechos fundamentales de todo el conglomerado social, es decir, entendiendo que no solo a nivel nacional sino también a nivel internacional en razón al bloque de constitucionalidad, resulta indispensable el respeto absoluto de la Dignidad Humana y la Libertad de Pensamiento, que desde algún punto de vista puede dificultar en la práctica la toma de decisiones de los operadores jurídicos pues debe hacerse un balance estricto respecto a los posibles efectos que causará la toma de una decisión que comprometa los elementos antes mencionados, ello por cuanto se hace necesaria la constante reformulación y expansión del Derecho Penal, sobre todo en lo que tiene que ver con la teoría del delito, tratando siempre de cubrir las deficiencias, otorgándosele al ciudadano siempre las debidas garantías como ser humano. Through this article, an analysis of the concept of conscience of illegality, reviewing the different scope that has been given to this notion throughout history through different theories, as well as the procedures that achieve exclude. Being mandatory to mention the implications for conscientious objection and considerations about noted Colombia 's Constitutional Court in cases found that although awareness of illegality proven , explicitly warns that you cannot talk about responsibility, because cannot ignore the current state founding principles and the fundamental rights of all the social structure, namely, understanding that not only nationally but also internationally due to the block of constitutionality, it is essential to absolute respect for the Human Dignity and Thought’s Freedom, which from some point of view in practice can hinder decision making legal operators to be weighed as strict about the possible effects that result in a decision that jeopardizes the above elements , this is necessary because the constant reformulation and expansion of criminal law , especially when it has to do with the theory of crime , always trying to fill gaps , granting the citizen always fair human being.
