The Political Constitution of Colombia of 1991, in article 29 makes reference to the right that has all person to a due process that must be applied in all judicial and administrative performance, and the test has constitucionalizado by the importance and the necessity to safeguard a fundamental right, therefore it is consecrated in same the right to request it and to make practice the test. By means of the present reflective article it is tried to explain the importance of the testimonial test in the Administrative Contentious process since this it has undergone important changes in the last years. Necessarily the subjects of the concept of the test as of the testimony must be included as much, a brief historical review, its classification, the elements of the testimony, the classification of the witnesses, to conclude with the importance and of having to declare as opposed to elaborating a parallel between Decree 01 of 1984 and Law 1437 of 2011 and like the position of the Council of State the subject.

La Constitución Política de Colombia de 1991, en el artículo 29 hace referencia al derecho que tiene toda persona a un debido proceso que debe aplicarse en toda actuación judicial y administrativa, y la prueba se ha constitucionalizado por la importancia y la necesidad para salvaguardar un derecho fundamental, por lo tanto está consagrado en la misma el derecho de pedirla y hacer practicar la prueba. Por medio del presente artículo reflexivo se pretende explicar la importancia de la prueba testimonial en el proceso Contencioso Administrativo ya que este ha sufrido importantes cambios en los últimos años. Necesariamente deben abarcarse los temas del concepto tanto de la prueba como del testimonio, una breve reseña histórica, su clasificación, los elementos del testimonio, la clasificación de los testigos, para concluir con la importancia y el deber de declarar elaborando un paralelo entre el Decreto 01 de 1984 y la Ley 1437 de 2011 y como la postura del Consejo de Estado frente al tema.
