El dolo eventual y la culpa con representación

Abstract

En este artículo se planteó la forma en que el Derecho Penal da respuesta a la problemática surgida frente a la distinción que se debe hacer de las modalidades de responsabilidad penal -dolo eventual y culpa con representación- en accidentes de tránsito ocasionados bajo el efecto del alcohol, para lo cual se analizaron las distintas posturas y criterios asumidos por la doctrina y la jurisprudencia en-pro de distinguir ambas instituciones jurídico penales. Se logró evidenciar la falta de claridad en cuanto a los elementos que se deben tener en cuenta a la hora de imputar uno u otra de estas modalidades de la responsabilidad, concluyéndose que frente a los accidentes de tránsito ocurridos bajo el influjo del alcohol, en los cuales se ocasionen muertes o heridos no debe imputarse responsabilidad a título de dolo eventual sino la de culpa con representación, una vez entendida la diferencia dogmática entre estas dos modalidades de la responsabilidad se abordan las consecuencias que en términos procesales y de punibilidad se presentan frente a la imputación de un homicidio a título de dolo o de culpa.

This article discusses how the penal law gives answers to the problematic arise in face to the distinction to make the modalities of penal responsibility, possible fraud and represented guilt in traffic accidents caused under the influence of alcohol; this was analyzed in different positions and assumed criteria for the doctrine and jurisprudence en favor to distinguish both penal juridical institutions. It was possible to demonstrate the lack of clarity regarding the elements that must be taken into account at time to impute one or the other of these modes of responsibility modalities , concluding that in consideration of the transit accidents occurred under the influence of alcohol, where it caused the death or injured should not be imputed responsibility at the name of possible fraud but the representation of guilt , once understood the dogmatic difference between these two modalities of responsibility the consequences are addressed that in procedural terms and punishability are presented en face to the imputation of homicide to tittle of intentional or guilty.
