El principio de seguridad jurídica y la extensión de la jurisprudencia del Consejo de Estado

Abstract

La ley 1437 de 2011 (CPACA) incluyó la figura de la Extensión de la jurisprudencia del Consejo de Estado , con el propósito de brindar a la comunidad, entre otros, el respeto a postulados constitucionales como el de igualdad de trato y el de seguridad jurídica. Sin embargo, el punto de inicio de este trabajo exploratorio sostiene lo contrario. Partiendo de ello, la hipótesis a defender es que no les genera seguridad jurídica a quienes acuden a la administración solicitando la extensión de la jurisprudencia del Consejo de Estado, entre otras razones, porque mientras no se elaboren sentencias absolutamente diáfanas en precisar qué constituye idéntica situación fáctica y jurídica ,las autoridades administrativas no tendrán la certeza de si deben o no hacer extensiva la jurisprudencia, propiciando de esta manera inseguridad jurídica.

The Law 1437 of 2011 (CPACA) included the figure of the Extension of the jurisprudence of the State s Council with the purpose of offering to the community the respect for the constitutional principles such as equal treatment and legal security. However, the starting point of this exploratory research presents and argues a contrary idea. Based on this, the hyphotesis which is going to be defended assures that there is not being generated legal security to those who come to the administration requesting the extension of the law of the State s Council. Because, while absolutely diaphanous statements are not being elaborated that oblige that it constitues and identical factual situation the administrative authorities do not have the certainty of whether or not to extend the law, thus promoting legal uncertainty.
