Trata de personas: una moderna forma de esclavitud

Abstract

El presente artículo procura informar tanto a la comunidad académica, como a la comunidad en general, en primer lugar, acerca de la problemática de la Trata de Personas , en segundo lugar, la vulneración extrema que se presenta a los Derechos Humanos cuando alguien es afectado por este flagelo, y en tercer lugar, el impacto producido en la sociedad y el papel del Estado colombiano frente al combate de este delito. Para tal propósito se realiza una descripción del fenómeno acusado como una especie de esclavitud moderna, sus víctimas y su desarrollo legal en el ordenamiento jurídico. El desarrollo de este escrito se desplegará bajo una definición conceptual de los enfoques aplicados al delito de la trata de personas y una descripción del mismo, se esbozará el marco jurídico por el cual se rige la legislación Colombia en materia de trata de personas y su constructivismo jurídico en la actualidad, finalmente se expondrán las conclusiones del tema abordado. "This article seeks to inform both the academic community and the community at large, first about the problem of ""Human Trafficking"", second extreme breach presented to the Human Rights and thirdly the impact occurred in society and the role of the Colombian state against combat this crime. For this purpose there is a description of the defendant as a kind phenomenon of modern slavery, victims and legal development in the legal system. The development of this paper will be deployed under a conceptual definition of the approaches to the crime of human trafficking and a description of it will outline the legal frame work which governs Colombia legislation on trafficking in persons and their progress now finally explains the findings of theme."
