Abstract

En este capítulo se hace un balance de la jurisprudencia del TS relativa a la protección que el sistema de la Seguridad Social dispensa a las situaciones de nacimiento y cuidado de los hijos, tanto de forma directa, con prestaciones por maternidad o adopción y de protección a la familia, como indirecta, con previsiones que incorporan las cargas familiares como variable para el acceso y/o cálculo de la cuantía de las prestaciones que atienden a otros riesgos. El objetivo es identificar los criterios de interpretación que se han seguido y cómo se han adaptado a la evolución de la normativa en la materia. Para ello, se lleva a cabo una revisión de las resoluciones de los últimos veinte años, desde las que versan sobre cuestiones más generales relacionadas con los requisitos de acceso a estas prestaciones, hasta las que resuelven problemas más recientes, como los surgidos a propósito de las situaciones de maternidad por subrogación; sin olvidar aquellas otras que contribuyen a explicar algunos de los últimos cambios que introduce el Real Decreto-Ley 6/2019 en orden a fomentar la corresponsabilidad en el cuidado de los hijos.
