Independencia del Poder Judicial en España

Abstract

En los últimos años, el Poder Judicial ha pasado a ser el foco de todo tipo de noticias y debates debido al sinfín de medidas y controversias que han puesto en duda si los jueces y magistrados realmente son independientes y si ejercen la función jurisdiccional con todas las garantías que tanto la Constitución como las leyes recogen. La Constitución española de 1978, como modelo de texto democrático, define al mismo como un “Estado social y democrático de derecho”, y ello se plasma en que se reflejen en él una serie de ideas y principios jurídicos esenciales para salvaguardar el Estado de Derecho y garantizar el correcto desempeño de los jueces de su labor de juzgar y hacer cumplir lo juzgado. Para ello, la propia Constitución recoge una serie de instituciones que serán las encargadas de velar por ello, estableciendo y desarrollando una serie de mecanismos para garantizar el importante papel que guarda el poder judicial en nuestro ordenamiento y evitar que tanto el poder legislativo como el ejecutivo puedan moldear o influenciar su toma de decisiones.
