Acoso moral en el trabajo: delimitación y tutela sancionadora

Abstract

El acoso moral en el trabajo no supone un fenómeno nuevo, entendido como conjunto de actos mediante los cuales una persona o grupo de personas ejercen, de forma reiterada en el tiempo, violencia psicológica sobre otra, dentro del marco de una relación interpersonal de carácter laboral, afectando a la integridad moral y dignidad de la víctima. Si bien, su análisis y tratamiento desde diversas ciencias, jurídicas y sociales, sí que resulta novedoso, pues se remonta a los años ochenta cuando el psicólogo Heinz Leymann inicia el estudio de lo que se denominó como mobbing. Esta figura, aun no siendo nueva, no goza de una regulación específica, dando lugar a una falta de cohesión normativa. Por ello, a través de este trabajo, se pretende esclarecer su figura, comenzando por intentar desarrollar una delimitación conceptual, analizando sus rasgos constitutivos y distinguiéndola de entre otras figuras afines a la misma y, finalmente, estudiar su tratamiento jurídico con especial énfasis en la tutela sancionadora.
