Abstract

La inclusión de este tipo de cláusulas en los pactos matrimoniales parece algo relativamente reciente, se hace necesario investigar los posibles antecedentes históricos de estas previsiones contractuales que, de alguna manera, sancionan la infidelidad matrimonial, su validez en los respectivos ordenamientos, así como la finalidad a la que servían.
