La jornada de trabajo en los contratos a tiempo parcial

Abstract

Desde sus orígenes, el contrato a tiempo parcial ha sido configurado por el legislador español como un instrumento de fomento del empleo y reparto del tiempo de trabajo. Sin embargo, las últimas reformas laborales han introducido grandes dosis de flexibilidad en beneficio de los intereses empresariales y en detrimento de los derechos de los trabajadores con jornadas inferiores a la jornada completa comparable. El objetivo fundamental de este trabajo es el análisis de las características y los principios básicos de esta modalidad contractual, tomando como punto de partida la reducción de la jornada. Como principio fundamental, se analiza la voluntariedad en dos fases diferentes: una primera, en el nacimiento del contrato o establecimiento inicial de la jornada y otra posterior, en la conversión o transformación contractual; además, la igualdad de derechos y la regla de la proporcionalidad, haciendo hincapié en los problemas de aplicación práctica y las distintas soluciones adoptadas por los Tribunales. Finalmente, se analizan los requisitos formales para la determinación de la jornada parcial, la distribución del tiempo de trabajo y su ampliación, a través del régimen específico de las horas complementarias.
