La relación entre el CEDH y el DIH en la jurisprudencia del TEDH

Abstract

La relación entre el derecho internacional de los derechos humanos (DIDH) y el derecho internacional humanitario (DIH) se explica comunmente a través del principio lex specialis. Sin embargo, ninguna de las dos funciones que puede ejercer este principio, ley especial deroga ley general (como nació en Roma) y ley especial interpreta ley general (como nació para describir la relación) sirve para explicar la cuestión de una manera completa. En este texto se pretenden exponer las ideas más básicas de la relación desde el punto de vista del CEDH como un derecho eminentemente fijo, que solo puede ser desplazado con las garantías del art. 17, y del DIH como un derecho fundamentalmente interpretador, cuyo mínimo solo debe ser exigido cuando en virtud del CEDH no es posible una protección mayor. A través de 5 asuntos de la jurisprudencia del TEDH (Loizidou, Varnava, MacCann, Al-Jedda y Bankovic) puede observarse la influencia directa que tiene el organo jurisdiccional en la relación entre el CEDH y el DIH. Aunque los criterios para inaplicar el CEDH sean claros, la forma en que el TEDH incorpore los principios del DIH a la aplicación del CEDH es determinante. Interpretados de una manera garantista, como hace el TEDH excepto en el caso Bankovic, deciden la responsabilidad de los Estados en una situación de conflicto armado.
