La vigencia jurídica del principio de igualdad tributaria

Abstract

El principio de igualdad del artículo 31.1 de la Constitución española debe articularse como igualdad ante los principios, marcando la actuación fiscal de todo legislador, y vinculándose a los demás principios constitucionales, como la capacidad económica o la progresividad; y por tanto conseguir la justicia tributaria. Asimismo, la igualdad en su aspecto interterritorial no puede ser entendida en términos absolutos, pues impediría el ejercicio competencial que tienen atribuidas las Comunidades Autónomas y los Ayuntamientos, además del principio de descentralización del Estado del artículo 2 de la Carta Magna. Se pretende analizar la utilidad práctica del artículo 31.1 en nuestra Constitución, y más concretamente del principio de igualdad; tenidas en cuenta las particularidades territoriales del Estado español.
