El despido objetivo por causas de empresa.

Abstract

La Reforma de 2012 del Estatuto de los Trabajadores ha modificado la regulación del despido objetivo por causas de empresa del artículo 52 c en relación con el artículo 51.1 de tal normativa, especialmente afectada ha resultado la causa económica. Con tales cambios, puede concluirse que se ha producido una merma de la finalidad compensadora propia del Derecho del Trabajo. Mediante el estudio de la causa económica antes y después de tal Reforma, puede verse que con las supresiones realizadas, se facilita la posibilidad del uso desleal de la normativa laboral, lo que contradice los principios inspiradores de esta disciplina. Se pretende, por tanto, conocer los caracteres definitorios de la causa económica mediante el estudio de su regulación antes y después de 2012, para llegar a una conclusión razonada sobre la oportunidad de tales modificaciones.
